- The Guest who books the reservation (‘Primary Renter’) is fully responsible for all other guests who
have access to the property during the reservation. It is fully the responsibility of the guest who books
the reservation to ensure all other guests read and understand the terms and conditions of this
agreement prior to anyone having access to the property. By reading the terms and conditions of this
agreement, guests are then deemed to be ‘Authorized Guests’. The property is limited to 10 guests
only and must be Authorized Guests of the Property. Only Authorized Guests are allowed access to use
the backyard amenities, including the fire pit, barbeque grill, and swimming pool during the length of
stay at the Property. By using these amenities, all guests recognize and fully understand certain things,
including:
• All guests fully understand this agreement and agree to the terms and conditions contained
herein. All guests are over the age of 18. Any guest under the age of 18 is not deemed authorized
under the terms and conditions of this agreement.
• Use of the fire pit and barbeque grill involve risks including but not limited to burning and
explosion, resulting in possible injury and death.
• There is no lifeguard on duty at any time and no pool diving is allowed. The Primary Renter along
with all Authorized guests are responsible for the safe operation of the pool and are responsible
for all persons using the pool/backyard amenities during your entire stay. The property is
designed for adult use only. The primary renter assumes all liability and recognizes all associated
risk of allowing any person under the age of 18 to enter the property. The primary renter must
ensure all guests are made aware that the property is designed for adult use only and any person
under the age 18 is strongly advised against entering the property. In the case that this strong
warning is not adhered to, the primary renter must exercise duty of care for all occupants of the
property and each occupant is responsible for their own health and safety with primary
caretakers being fully responsible for any children who are under legal age.
The use of the pool facilities during your stay involves certain risks, including but not limited to:
o The risk of injuries resulting from the malfunction of the pool equipment;
o The risk of injuries resulting from tripping, slipping, or falling in the pool area/backyard
area;
o The risk of injuries resulting from unsupervised divers and swimmers colliding; The risk of other injuries resulting from participation in any action in the pool/backyard
area;
o The risk of drowning or other cause of death/injury resulting from participating in any
action in the pool or other areas of the property.
o I recognize and fully understand that the above list is not a complete or exhaustive list of
all possible risks; the list only provides examples of types of risks that I am assuming.
In exchange for the Owner allowing all guests to utilize the pool and Property during their stay, all guest
occupants of the Property hereby agree to the reasonable conditions below. All guest occupants fully
intend and choose to waive their legal rights, as stated below:
1. TO WAIVE ANY AND ALL CLAIMS that the guest occupants have or may have in the future against
the Owner, its directors, officers, agents, or representatives (hereinafter referred to as
“Releasees”) relating to or in any way connected to the guests’ use of the property.
2. TO RELEASE THE RELEASEES from any and all liability for any loss, damage, injury, expense, or
other cost that you or your guests may suffer resulting from or in any way connected to the use
of the Property for any cause whatsoever, INCLUDING NEGLIGENCE ON THE PART OF THE
RELEASEES.
3. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability related to Property
damage, personal injury, and/or to any third-party claim resulting from or in any way connected
to the use of the Property.
I acknowledge that I am over the age of 18 and that I will be responsible and will adhere to all the rules
of the Property and that I will supervise all guests present at the Property and ensure that they use the
Property amenities in a safe and reasonable manner. I acknowledge the warning that the property is
specifically designed for adult use only and hereby undertake all legal risk associated with having minors
on the premises and using the property. I also acknowledge that property quiet time is from the hours
of 10:00pm-8:00am and understand if there are any noise complaints received from neighbors or law
enforcement, this may result in immediate check out of the reservation with no refund and possible
damages and loss of security deposit. I further acknowledge that all local city, county, and state rules
and ordinances apply to use of the property throughout the stay. Any consumption of alcohol or legal
substances in the backyard space is strictly not advised, and no smoking of any substance is permitted
inside the property. Any consumption of alcohol or legal substances is strictly the responsibility of the
guests. Any consumption or serving of alcohol or other substances to any minors is strictly prohibited as
well as engaging in any illegal drug use by any guest, and will result in automatic termination of the rental
agreement with no refund, loss of security deposit, and possible further damages. I and my guests fully
acknowledge and agree that any failure to adhere to any of these rules and responsibilities of the
property may result in termination of the rental agreement with no refund, loss of security deposit, and
possible further damages. I acknowledge that this Waiver, Release, and Agreement is fully effective and shall be effective and
binding upon all guests, heirs, next of kin, executors, administrators, representatives, assignees, or
anyone else authorized to act on my behalf or behalf of my estate. I represent and warrant that I have
agency authority to sign this Release of Liability on behalf of myself and all guests.
I have read and understood this document and have had the opportunity to consult with counsel
regarding the effects of this waiver of rights. I am aware that by signing this document, I and all guests
are waiving certain legal rights that we may have against the Releasees, and fully agree to do so,
knowingly and voluntarily.
