**Wildlife & Maintenance:**

We are in a tropical climate, so you may encounter lizards, insects, bugs, and other creatures that are common in Florida. Despite regular pest control, bugs may still enter the home if doors are left open or are tracked in on shoes or luggage. Please keep doors closed, dispose of trash properly, and store food responsibly. Refunds or cancellations will not be issued due to the presence of normal bugs and wildlife.

Please refer to the house rules for additional information. By booking and continuing with your reservation, you agree to all terms and conditions.

Additional rules
NO PERMANENT RESIDENCY:
-Guests agree that use of the property is on a temporary and transient basis only.
-Guests may not use the property as a permanent residence.
-Guest’s permanent residence is and will remain elsewhere than at the property.

- As per the HOA regulations, guests are not permitted to park or wash boats, jet skis, or any other watercraft on the property, including the driveway.

General Rules:

1. No Parties or Events: The property is for residential use only. Parties or events are not allowed.

EVENTS POLICY:
The premises may not be used for parties, receptions, weddings, or any type of function which would cause abnormal wear and tear or mess, or exceed the maximum number of occupants specified in this lease without written permission. **Evidence of these activities will result in a fine for up to $1,000.

2. Quiet Hours: Please respect the neighbors and observe quiet hours between 10 PM and 8 AM.
3. We are a no-pet home due to severe allergies. No animals are allowed.

Cleanliness:

4. Cleaning Dishes: Guests are expected to wash and put away dishes before check-out. A dishwasher is available for use.
5. Trash Disposal: Please dispose of trash in designated bins. Garbage pick-up days are Tuesday and Friday. Place trash cans by the street on Monday and Thursday evenings.
6. Shoes Off: To help keep the property clean, please remove shoes upon entering.
7. No Sand in the House: Wash off sand from yourself and beach gear at the beach showers and in the yard before returning inside.

Security and Safety:

8. Lock Doors and Windows: Always lock doors and windows when leaving the property and ensure the property is secure during your stay.
9. No Unauthorized Guests: Only registered guests are allowed on the property.
10. Appliance Use: Use appliances and amenities with caution.
11. Fire Extinguisher: A fire extinguisher is available for emergencies. Guests are responsible for any charges incurred for its use.

Respect for Property:

12. Furniture and Decor: Treat the property and its furnishings with care. Report any damage to the host immediately.
13. Damages and Missing Items: Guests are responsible for reimbursement for any damages or missing items after their stay.
14. Personal Belongings: Guests are responsible for their personal belongings. The host is not liable for lost or stolen items.
15. No Bikes inside the house

Check-Out:

16. Check-Out Time: Check-out time is 10 AM. Late check-outs may incur an additional fee unless arranged in advance.
17. Sign Out of TV Accounts: Remember to sign out of your TV streaming accounts before check-out.
18. Leave the Property Tidy: Tidy up the property, including putting used linens and towels in designated areas.
19. Dispose of Food: Throw away all food from the fridge and cabinets before check-out.
19. Return Keys/Access Items: Return all keys, access cards, or any provided items to the designated location or as instructed by the host.
21. Please leave the AC set to 75°F upon checkout.

PROHIBITED ACTIVITY:
-Smoking of any kind, illegal substances and illegal activity of any kind on the property, inside the house or the lanai are prohibited. Evidence of prohibited activities will result in fines and/or law enforcement. Fine: $1000 minimum.
-Criminal Activity Prohibited. Use of the Property for any criminal activity is prohibited and may result in fines, prosecution, and/or your immediate removal from the Property. This prohibition extends to use of the Property’s internet service, if any, for criminal activity, including but not limited to unlawful downloads of copyrighted material, including movies, music, software, or other material. We may cooperate with any investigation of alleged criminal activity that occurred at the Property during your stay.
-Parties and other events are prohibited at the Property.
-No commercial photography and filming at the Property without our express written permission. (If approved, applicable occupancy limits and other rules under Airbnb's Party and Events Policy will apply, and additional conditions and fees may apply.)
-No tents or other structures may be erected on the property.
-No mail forwarding to the address.

INCLEMENT WEATHER, UNINHABITABLE or ACT OF GOD POLICY:
Should the premises be destroyed by fire or other casualty, extreme weather, pandemic or act of God to become unfit for human habitation or to prevent travel to the property then these presents shall thereby be ended with NO refund to the GUEST for any rent term unused. We highly recommend you purchase travel insurance to cover any losses

INDEMNITY:
You agree to hold harmless and indemnify Emerald Avenue and Owner, and their respective affiliates, for and from all claims for property damage, personal injury, or monetary loss resulting from your actions or omissions, and the actions or omissions of other occupants, during or relating to your stay.

LEGAL ACTION:
If any legal action or proceeding be brought by either party to this agreement, the prevailing party shall be reimbursed for all reasonable attorney’s fees, court filing fees or any other expenses incurred in such proceeding in addition to other damages awarded. Due to the fees that can be charged by attorneys, it is agreed by the parties that both sides will waive their right to a jury trial and will first attempt mediation or arbitration if the claim exceeds small claims court limits.

-Guests will be immediately evicted without the return of funds paid upon violation of any part of this policy.

-By booking and going through with this reservation, you agree to all terms and conditions.
